Based on some of Galanter's strategies, our paper tries, in its first section, to question the common core, rejecting three of the most commons arguments used to explain the so called \"litigation explosion\" in Brazil: that Brazilians are too litigious, that our Judiciary is too small and that access to courts is too easy. In the second section, using social security claims as an example, we try to provide a different reading of the causes for so many lawsuits in that area.
